The Zoning and Land Use Practice Group at Carson Fischer provides comprehensive services relating to the development and use of real property throughout the state of Michigan. Legislation in Michigan at all governmental levels has created a complex maze of hurdles and roadblocks that property owners must deal with in order to obtain an approved use of a proposed project. Quite often, clients find themselves caught in a municipal web of delays and confusion with no end in sight while they continue to incur costs, fees and expenses. Our years of experience with State law, municipalities and their ordinances help us lead our clients through the governmental approval process. Our attorneys regularly represent clients before local municipalities and their boards or commissions with regard to rezoning of property, approval of site plans, planned developments, conditional rezonings, special land use permits and variances. We have represented our clients before the Michigan Departments of Natural Resources, Transportation and Environmental Quality and various county road commissions. Through our knowledge, experience and relationships, we are able to lead clients to expeditious and successful conclusions of the approval process and are often able to incorporated “new” value to the project through creative thinking.

While our primary goal to is amicably and quickly achieve a desired use, when necessary, we have the capabilities to successfully litigate matters to enforce our client’s constitutional rights or otherwise. Led by Robert M. Carson, the Firm secured a $70,000,000 judgment against the city of Novi on behalf of its client in the very publicized case of Sandstone v. City of Novi and also successfully litigated against Northville Township on behalf of REIS Norville LLC.
